{"id":19647,"date":"2020-07-05T12:25:18","date_gmt":"2020-07-05T10:25:18","guid":{"rendered":"https:\/\/afteegypt.org\/?p=19647"},"modified":"2020-07-05T12:25:18","modified_gmt":"2020-07-05T10:25:18","slug":"court-of-cassation-upholds-15-years-imprisonment-sentence-for-ahmed-douma","status":"publish","type":"post","link":"https:\/\/afteegypt.org\/en\/legal-profiles-en\/legal-news-en\/2020\/07\/05\/19647-afteegypt.html","title":{"rendered":"AFTE submits a communication to the attorney general regarding assaulting Ahmed Doma"},"content":{"rendered":"<p><span style=\"color: #800000;\"><b>25 July 2022\u00a0<\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;\">On July 25, the Association for Freedom of Thoughts and Expression submitted a communication to the attorney general, Hamada El-Sawy, against the deputy warden and head detective of Tura Prison, in addition to a member of the prison force, officer Ahmed Elwakeel, regarding assaulting activist Ahmed Doma and preventing him from necessary medical care.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On July 19, the deputy prison warden and officer Ahmed Elwakeel tied the hands and feet of Doma &#8211; who is serving a 15-year prison sentence pending the case known in the media as the Council of Ministers&#8217; events, using handcuffs and assaulted him with their shoes, causing injuries and bruises in separate areas of Doma&#8217;s body, the prison administration also prevented him from reporting the assault incident.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The communication was based on provisions of Article No. 129 of Penal Code No. 58 of 1937, which stipulates that every public official who used cruelty to people using his job and caused pain to their bodies shall be punished by imprisonment for a period not exceeding one year and a fine not exceeding 200,000 EGP, and Article (123) which stipulates that every public official who uses authority given to his job to stop the implementation of orders issued by the government or the provisions of laws and regulations shall be punished by imprisonment and removal from office, in addition to Article (241) of the same law, which stipulates that anyone who strikes or wounds people using any weapons, stick, or tools shall be punished with imprisonment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">AFTE urges the attorney general, Hamada El-Sawy, to urgently open an investigation into the incident of assaulting Doma, hold accountable those responsible for it, and provide Doma with the necessary medical care to recover from injuries as a result of being assaulted in prison.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"color: #800000;\">5 July 2020\u00a0<\/span><\/strong><\/p>\n<p>The Court of Cassation rejected, today, the appeal submitted by the political activist, Ahmed Saad Douma, against the ruling of the Cairo Criminal Court, and upheld his 15 years imprisonment sentence and a fine of 6 million pounds, the value of damages in the case known as the Cabinet Clashes.<\/p>\n<p>Douma is serving a 15 years sentence in case no. 8629\/2011 Sayeda Zainab\/Criminal, which is registered with number 3528\/2011 General\/ Downtown\u00a0Cairo.
