{"id":23791,"date":"2021-07-18T18:39:59","date_gmt":"2021-07-18T16:39:59","guid":{"rendered":"https:\/\/afteegypt.org\/?p=23791"},"modified":"2021-07-18T18:39:59","modified_gmt":"2021-07-18T16:39:59","slug":"aftes-weekly-legal-bulletin-july-11-july-18-2021","status":"publish","type":"post","link":"https:\/\/afteegypt.org\/en\/legal-profiles-en\/weekly-legal-bulletin-en-2\/2021\/07\/18\/23791-afteegypt.html","title":{"rendered":"AFTE\u2019s Weekly Legal Bulletin (July 11: July 18, 2021)"},"content":{"rendered":"<blockquote><p><span style=\"color: #800000;\"><strong>Renewing the detention of 20 defendants, releasing \u201cEsraa Abdel Fattah,\u201d \u201cMahienour El-Massry,\u201d and three others, and extending the precautionary measures of five more<\/strong><\/span><\/p><\/blockquote>\n<p><span style=\"color: #800000;\"><strong>The Legal Bulletin covers the lawsuits in which AFTE provides the necessary legal aid, following AFTE\u2019s framework.<\/strong><\/span><\/p>\n<h3><span style=\"color: #ffffff;\"><strong><span style=\"background-color: #800000;\">Criminal Courts:<\/span> <\/strong><\/span><\/h3>\n<p>The Third Circuit Terrorism renewed the detention of both \u201cMohamed Salah Abdel Aziz\u201d and \u201cAhmed Yousry Ghaly\u201d for 45 days, and The Council Chamber of the Criminal Court renewed the detention of both \u201cMohamed Mamdouh Abdel Halim\u201d and \u201cZeyad Abou El-Fadl\u201d, pending Case No. 855 of 2020, Supreme State Security.<\/p>\n<p>The investigations charged them with joining and financing a terrorist group and spreading false news through using a social media account.<\/p>\n<p>And on Sunday\u2019s July 11 session, The Council Chamber of the Criminal Court held at Institute of Police Secretaries had issued a decision to release \u201cAmr Adel\u201d with precautionary measures, pending Case No. 558 of 2020 Supreme State Security, \u201cAmr\u201d was arrested on July 13, 2020, from Giza\u2019s railway station \u201cAmr\u201d was arrested on July 13, 2020, from the railway station against the background of sharing a post on \u201cFacebook\u201d.<\/p>\n<p>It also renewed the pretrial detention of \u201cBelal Abdel Razek\u201d and \u201cMohamed Gaber Soliman El-Masry\u201d for 45 days pending Case No. 488 of 2019 Supreme State Security, both of the defendants were arrested in 2019 and their detention is still pending renewal till now.<\/p>\n<p>And also considered the detention order of the defendants of\u00a0 Case 751 of 2020 Supreme State Security, and ordered to renew the detention of two defendants for 45 days, and to extend the precautionary measures of two others for 45 days, and the investigations had charged them with joining Ultras White Knights.<\/p>\n<p>The Third Circuit Terrorism renewed the pretrial detention of vice president of the \u201cStrong Egypt\u201d political party \u201cMohamed Ali Ibrahim Al-Qassas\u201d for 45 days pending Case No. 786 of 2020, Supreme State Security. Notably, this case is Al-Qassas\u2019s third case, as the security forces arrested him in February 2017, from Salah Salem road while he was heading to attend a wedding<\/p>\n<p>In the same context, the third circuit terrorism considered the renewal of the detention order of Dr. Ahmed AlTohamy AbdelHay, who is working as an assistant professor of political science at the Faculty of Economic Studies and Political Science at Alexandria University since, and is in pretrial detention pending case No. 649 of 2020, for almost one year, as he was arrested in the 3rd of June last year, and was subjected to enforced disappearance for more than 2 weeks, and AFTE issued a <a href=\"https:\/\/afteegypt.org\/en\/advocacy-en\/joint-statements-en\/2021\/06\/03\/22774-afteegypt.html\">statement <\/a>that demands his release<\/p>\n<p>On Monday\u2019s session July 12, 2021, The Council Chamber of the Criminal Court renewed the detention of the Assistant Professor at National Research Centre \u201cHamed Sedeek,\u201d for 45 days pending Case No. 1356 of 2019, Supreme State Security. \u201cSedeek\u201d was arrested from his house on September 23, 2019, and he suffers from cruel detention conditions in Al-Aqrab Prison, in addition to being prevented from doing outdoor sports and receiving letters and books according to his lawyers and family\u2019s testimonials.<\/p>\n<p>The pretrial detention of \u201cIslam Ali Muhammed\u201d was renewed pending Case No. 1898 of 2019 Supreme State Security by The Council Chamber of the Criminal Court.<\/p>\n<p>Despite exceeding two years in pretrial detention, The Council Chamber of the Criminal Court held at Institute of Police Secretaries renewed the detention of lawyer \u201cAmr Nohan\u201d for 45 days pending Case No. 741 of 2019 Supreme State Security, \u201cNohan\u201d was arrested in 2019, from Karmus Police Station while performing his job as a lawyer<\/p>\n<p>And pending Case No. 65 of 2021 Supreme State Security, The Council Chamber of the Criminal Court renewed the detention of \u201cMohamed Safani Kobeisy Marzouk\u201d, \u201cHussein Ali Hussein\u201d and \u201cNaglaa Fathy Fouad\u201d for 45 days, it should be noted that both \u201cMohamed Safani\u201d and \u201cNaglaa Fathy\u201d were recycled in the current case.<\/p>\n<p>pending Case No. 1956 of 2019 Supreme State Security, The Council Chamber of the Criminal Court renewed the detention of \u201cAkram Mostafa Farouk, Mohammad Abd Ellah Mokhaimer, Mohammad Ahmed Mansour\u201d, extended the precautionary measures for \u201cAhmed Mohamed Ali\u201d, and issued a decision to release lawyer \u201cWalid Elgendy\u201d.<\/p>\n<p>And also ordered to renew the detention of \u201cAhmed Hassanein Mohamed Moussa\u201d for 45 days pending Case No. 1475 of 2019 Supreme State Security, with charges of joining a terrorist group, committing a financing crime, spreading false news, and misusing social media.<\/p>\n<p>And issued a decision to release \u201cHossam El-Saadany\u201d with precautionary measures, pending Case No. 558 of 2020 Supreme State Security, after he was arrested from his house in Alexandria on March 25, 2020.<\/p>\n<p>And Today, July 18, The Council Chamber of the Criminal Court had decided to release \u201cMahienour El-Massry\u201d pending Case No. 488 of 2019 Supreme State Security, \u201cMahienour\u201d was arrested on September 22, 2019, in front of the State Security Prosecution headquarter, while attending investigations with several defendants as a lawyer.<\/p>\n<p>It also decided to release journalists \u201cMoataz Wednan\u201d pending Case No. 1898 of 2020, and \u201cMostafa Al-Assar\u201d pending Case No. 1898 of 2019.<\/p>\n<h3><span style=\"color: #ffffff;\"><strong><span style=\"background-color: #800000;\">Supreme State Security Prosecution<\/span> <\/strong><\/span><\/h3>\n<p>Abu Kabir Prosecution had decided to detain \u201cOmar Mahmoud Abdel Rahman Al-Hout\u201d 15 days pending investigations, and to include him in lawsuit No. 1873 State Security Misdemeanour of Abu Kabir.
