{"id":31385,"date":"2022-07-12T13:57:04","date_gmt":"2022-07-12T11:57:04","guid":{"rendered":"https:\/\/afteegypt.org\/?p=31385"},"modified":"2022-07-12T14:06:20","modified_gmt":"2022-07-12T12:06:20","slug":"36-organizations-urge-egyptian-authorities-to-end-crackdown-on-civil-society-organizations-and-peaceful-protests-for-a-successful-cop27","status":"publish","type":"post","link":"https:\/\/afteegypt.org\/en\/advocacy-en\/2022\/07\/12\/31385-afteegypt.html","title":{"rendered":"36 organizations urge Egyptian authorities to end crackdown on civil society organizations and peaceful protests for a successful COP27"},"content":{"rendered":"<p><span style=\"color: #800000;\"><b>Egypt:\u00a0 Statements on COP27 Imply Restricting Activism<\/b><\/span><\/p>\n<p><span style=\"color: #800000;\"><b><i>Uphold Rights to Free Expression at Environmental Summit\u00a0<\/i><\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Egyptian authorities should ease their grip on civic space and uphold the rights to freedom of expression, association, and peaceful assembly to enable a successful climate summit, known as the COP27, in Egypt, 36 organizations said today.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">COP27 brings together state parties to the UN Framework Convention on Climate Change as well as thousands of experts, journalists, and representatives from businesses and non-governmental groups. COP27, to be held in November 2022, is an important opportunity for the international community to meet and discuss ambitious, rights-based climate action.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In an <\/span><a href=\"https:\/\/apnews.com\/article\/climate-politics-africa-sameh-shoukry-ef68f280f3fadcbb337f673ee55a2762\"><span style=\"font-weight: 400;\">interview<\/span><\/a><span style=\"font-weight: 400;\"> with The Associated Press on May 24, Egypt\u2019s Foreign Minister Sameh Shoukry\u00a0 said that his government is planning to designate &#8220;a facility adjacent to the conference center&#8221; in Sharm El-Sheikh, in the Sinai peninsula, where the meeting will be held, \u00a0 where activists can hold protests and voice their opinions.\u00a0 He also said that the government will provide participants \u201caccess, as is traditionally done on one day of the negotiations, to the negotiating h[all] itself.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The\u00a0 organizations are concerned about the implications of Shoukry\u2019s comments on the right to peaceful activism at the COP27. Given <\/span><a href=\"https:\/\/www.hrw.org\/world-report\/2021\/country-chapters\/egypt\"><span style=\"font-weight: 400;\">existing restrictions on<\/span><\/a><span style=\"font-weight: 400;\"> protest and assembly in Egypt that amount to their <\/span><a href=\"https:\/\/www.hrw.org\/news\/2019\/09\/21\/egypt-respect-right-peaceful-protest\"><span style=\"font-weight: 400;\">effective criminalization<\/span><\/a><span style=\"font-weight: 400;\">, the Foreign Minister\u2019s comments imply that the Egyptian authorities will not tolerate\u00a0 protest outside this \u201cgovernment-designated\u201d space. .\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under\u00a0 international human rights law and <\/span><a href=\"https:\/\/www.oas.org\/en\/iachr\/expression\/publications\/Protesta\/ProtestHumanRights.pdf\"><span style=\"font-weight: 400;\">standards<\/span><\/a><span style=\"font-weight: 400;\">, demonstrations should be facilitated as a general rule within \u201csight and sound\u201d of their target audience. The Egyptian authorities should\u00a0 unconditionally allow peaceful protests and gatherings around the time of COP27, including in Cairo, the Egyptian capital,\u00a0 and other cities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Egyptian authorities should also end the <\/span><a href=\"https:\/\/www.amnesty.org\/en\/documents\/mde12\/5638\/2022\/en\/\"><span style=\"font-weight: 400;\">relentless assault<\/span><\/a><span style=\"font-weight: 400;\"> on human rights defenders, civil society organizations, and the independent media. Their tactics include\u00a0 unfounded <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/09\/egypt-chance-to-end-seven-year-sham-case-against-brave-ngos\/\"><span style=\"font-weight: 400;\">criminal investigations<\/span><\/a><span style=\"font-weight: 400;\">, arbitrary detention, summons for coercive questioning, threats to close independent organizations, <\/span><a href=\"https:\/\/www.hrw.org\/news\/2016\/11\/02\/egypt-lift-abusive-arbitrary-travel-bans\"><span style=\"font-weight: 400;\">travel bans<\/span><\/a><span style=\"font-weight: 400;\">, and other <\/span><a href=\"https:\/\/www.hrw.org\/news\/2021\/07\/15\/qa-legal-framework-and-environment-nongovernmental-groups-ngos-egypt\"><span style=\"font-weight: 400;\">restrictive measures<\/span><\/a><span style=\"font-weight: 400;\"> that risk undermining the ongoing civil society participation needed for a positive outcome of COP27.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Robust and rights-respecting climate action requires the full and meaningful participation of all stakeholders including states, activists, civil society and representatives of Indigenous peoples and groups most vulnerable to the harm of climate change. Activists play an important role in the global climate debate by providing relevant information to policymakers and the media. And nongovernmental groups can only carry out their important work where they can effectively exercise their right to freedom of assembly.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">International and Egyptian civil society groups fear that the restrictions imposed by the Egyptian authorities would hinder the full and meaningful participation of activists, human rights defenders, civil society, and Indigenous peoples representatives at COP27.\u00a0 Concerns are heightened by the Egyptian authorities <\/span><a href=\"https:\/\/www.hrw.org\/news\/2022\/01\/13\/egypt-no-end-systematic-repression\"><span style=\"font-weight: 400;\">abysmal record<\/span><\/a><span style=\"font-weight: 400;\"> of cracking down on civil society organizations and punishing <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2021\/01\/egypts-targeting-human-rights-defenders-must-stop-says-un-expert\"><span style=\"font-weight: 400;\">human rights activism<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.madamasr.com\/en\/2021\/12\/09\/news\/u\/cpj-with-25-journalists-detained-egypt-3rd-worst-jailor-of-media-workers-globally\/\"><span style=\"font-weight: 400;\">independent journalism<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Civil society organizations and the UN human rights mechanisms have long <\/span><a href=\"https:\/\/www.hrw.org\/news\/2019\/09\/27\/egypt-hundreds-arrested-nationwide-crackdown\"><span style=\"font-weight: 400;\">documented<\/span><\/a><span style=\"font-weight: 400;\"> the Egyptian authorities\u2019 <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2019\/10\/un-experts-urge-egypt-end-crackdown-protesters-and-human-rights-defenders\"><span style=\"font-weight: 400;\">crackdown<\/span><\/a><span style=\"font-weight: 400;\">\u00a0 on freedom of peaceful assembly. In 2013, the authorities passed <\/span><a href=\"https:\/\/www.hrw.org\/news\/2013\/11\/26\/egypt-deeply-restrictive-new-assembly-law\"><span style=\"font-weight: 400;\">Law No. 107\/2013<\/span><\/a><span style=\"font-weight: 400;\"> on Organizing the Right to Public Meetings, Processions and Peaceful Protests, which grants security forces free rein to ban protests and to use unnecessary and excessive force against peaceful protesters.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The authorities have used this law, in addition to\u00a0 the draconian colonial era Law No.10\/1914 on assemblies, to prosecute thousands of peaceful protesters in grossly <\/span><a href=\"https:\/\/www.amnesty.org\/en\/documents\/mde12\/4052\/2021\/en\/\"><span style=\"font-weight: 400;\">unfair mass trials<\/span><\/a><span style=\"font-weight: 400;\">. Additionally, security forces have consistently used unlawful force, sometimes lethal, and mass arrests to disperse protests. No security or military official has been brought to justice for the deaths of <\/span><a href=\"https:\/\/www.hrw.org\/news\/2014\/08\/12\/egypt-raba-killings-likely-crimes-against-humanity\"><span style=\"font-weight: 400;\">hundreds of people<\/span><\/a><span style=\"font-weight: 400;\"> during the dispersal of sit-ins in Rabaa al-Adawiya and al-Nahda squares in Greater Cairo on 14 August 2013.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The crackdown sent a chilling message across Egypt, instilling fear\u00a0 and deterring people from exercising their right to peaceful assembly. The <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2020\/10\/egypt-rare-protests-met-with-unlawful-force-and-mass-arrests-2\/\"><span style=\"font-weight: 400;\">rare protests<\/span><\/a><span style=\"font-weight: 400;\"> that have taken place in recent years have been met again with unlawful use of force and mass arrests, including\u00a0 the September 2019 and September 2020 anti-government protests. Security forced rounded up thousands of protesters,\u00a0 activists, human rights defenders, lawyers, and bystanders, including children, some of whom were <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2019\/10\/egypt-largest-wave-of-mass-arrests-since-president-abdel-fattah-al-sisi-came-to-power\/\"><span style=\"font-weight: 400;\">subject<\/span><\/a><span style=\"font-weight: 400;\"> to enforced disappearance.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Egyptian authorities have equally shown little tolerance even toward protests not directed at or critical of the authorities. In November 2020, Egyptian authorities arbitrarily arrested and <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2020\/11\/egypt-protests-by-sudanese-migrants-and-refugees-over-brutal-killing-of-a-child-met-with-violence-and-arrests\/\"><span style=\"font-weight: 400;\">detained 70 Sudanese<\/span><\/a><span style=\"font-weight: 400;\"> migrants and refugees engaged in a peaceful protest following the killing of a Sudanese child by an Egyptian man. Police beat protesters,\u00a0 using\u00a0 racial and xenophobic slurs, witnesses said. In December 2021 and January 2022, Egyptian security forces detained at least <\/span><a href=\"https:\/\/www.hrw.org\/news\/2022\/03\/27\/egypt-police-target-sudanese-refugee-activists\"><span style=\"font-weight: 400;\">30 Sudanese<\/span><\/a><span style=\"font-weight: 400;\"> activists who organized protests at the Cairo headquarters of the United Nations High Commissioner for Refugees (UNHCR) and subjected them to forced labour and beatings.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Egyptian authorities should\u00a0 immediately and unconditionally release anyone\u00a0 arbitrarily detained solely for the peaceful exercise of their human rights or for\u00a0 their religion, gender identity, or sexual orientation. The authorities should also amend legislation so that it is in line with Egypt\u2019s obligations under international law, including by repealing or substantially amending laws that unduly restrict and criminalize the exercise of human rights, including Law No.107\/2013 on protests, Law No.10\/1914 on assemblies, and the 2019 NGO law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The authorities should pledge to uphold the right to freedom of peaceful assembly at all times, including during international events, and refrain from unduly limiting protests to a specific designated area.\u00a0 UN member states, particularly those attending COP27, should\u00a0 urge the Egyptian authorities to end limitations on freedom of\u00a0 assembly, association, and expression\u00a0 and take other meaningful steps to address concerns by civil society and ensure their safe and meaningful participation that can contribute to a successful COP27.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Signatories:\u00a0<\/b><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Alliance for Rural Democracy<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Amnesty International\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Arab Resource &amp;
