The court adjournment came in order to review the case files and prepare for the defense\u2019s requests. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">During the session, the Supreme State Security Prosecution read the referral order against the defendants, who denied the charges brought against them, namely: joining a terrorist group knowing its purposes; and participating with others in a gathering composed of more than five persons likely to endanger public order, the purpose of which was to commit crimes of assault against persons by using force and violence and to influence public authorities in the performance of their duties. The following offenses were alleged to have been committed by them in execution of the intended purpose of the gathering:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, they used force and violence against public officials and persons entrusted with a public service, namely officers and soldiers of the Alexandria Governorate Security Directorate, to unlawfully compel them to refrain from performing their duties, by assaulting them with beatings, pushing, and throwing stones at them, to compel them to refrain from dispersing their gathering and releasing those who had been arrested, and they did not achieve their goal by doing so.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Second, they deliberately endangered public land transportation and disrupted its operation by blocking the public road on the Alexandria Corniche, which exposed the safety of public transport to danger and disrupted its work flow.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Al\u2011Dahma\u2019s defense requested a copy of the case files, and to plead at the next session, They also requested permission to submit a flash drive containing videos that might alter the court&#8217;s opinion in the case. Furthermore, the defense requested the release of Al-Dahma and Ragab on a guarantee of residence under Article 143 of the Criminal Procedure Code, citing that they have been held in pretrial detention for more than two years despite the law setting two years as the maximum period for pretrial detention.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is noted that Omar al\u2011Dahma works as a graphic designer; he was arrested at his home in connection with pro\u2011Palestine demonstrations in October 2023 and was referred to criminal trial on November 24, 2025.<br \/>\n<\/span><span style=\"color: #800000;\"><b><br \/>\n10 May 2026 &#8220;After over 5 Months of Legal Neglect, Court of Appeal to Begin Omar El-Dahma\u2019s Trial on June 7&#8221;\u00a0<\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Cairo Court of Appeal has set June 7 as the date to begin proceedings in the trial of Omar Mohamed Mohamed El-Dahma, scheduled to be held before the Second Circuit of the Criminal Court at Badr City Reform and Rehabilitation Center, in case No. 2469 of 2023 (State Security Supreme).<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Security forces arrested El-Dahma in front of his home in the Miami district of Alexandria, in connection with the pro-Palestine demonstrations in October 2023. Earlier, the prosecution referred him to criminal trial without allowing the defense to review the referral order or the case files. As a result, the defense was unable to know the charges under which El-Dahma was referred to trial, since the prosecution did not send the case papers to the competent Court of Appeal. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">This prompted the Association for Freedom of Thoughts and Expression to petition the Public Prosecutor, demanding <\/span><span style=\"font-weight: 400;\">ElDahma\u2019s immediate release, as he has exceeded the legally prescribed maximum period of pretrial detention without being brought before the competent judicial authority. And also urges the prompt transmission of his case file to the Court of Appeal to schedule a trial session, in accordance with the law and his constitutional rights. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"color: #800000;\"><b><br \/>\n3 May 2026<\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Association for Freedom of Thought and Expression (AFTE) has submitted a petition to the Public Prosecutor, registered under No. <\/span><span style=\"font-weight: 400;\">1692540 of 2026 <\/span><span style=\"font-weight: 400;\">(Public Prosecutor Petitions), on behalf of its client, <\/span><span style=\"font-weight: 400;\">Omar Mohamed Mohamed ElDahma<\/span><span style=\"font-weight: 400;\">, requesting his mandatory release and the rectification of the procedural irregularities in his case, in accordance with the provisions of the Code of Criminal Procedure.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">On November 24, 2025, the Supreme State Security Prosecution referred <\/span><span style=\"font-weight: 400;\">ElDahma to criminal trial, after nearly two years in pretrial detention. However, the prosecution refused to allow the defense to review the referral order or the case files, leaving the defense unaware of the charges. The case file has not yet been transmitted to the competent Court of Appeal to assign a circuit and set a hearing date.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The petition is based on two main grounds:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, the violation of Article 214 bis (A) of the Criminal Procedure Law, which mandates the immediate referral of the case file to the clerk\u2019s office of the Court of Appeal. Where the defense requests time to review the file, the president of the court must set a period not exceeding ten days. This has not occurred, thereby obstructing ElDahma\u2019s right to appear before his natural judge.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Second, the absence of a legal basis for his continued detention. The defense affirmed that the ongoing detention of ElDahma without being presented before the competent criminal court or the advisory chamber constitutes a grave violation and an unlawful infringement of personal liberty, in contravention of Articles 143 and 151 of the Criminal Procedure Law (Law No. 150 of 1950). Accordingly, his detention has become arbitrary and unlawful, necessitating his immediate release.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The defense team calls on the Public Prosecutor for ElDahma\u2019s immediate release, as he has exceeded the legally prescribed maximum period of pretrial detention without being brought before the competent judicial authority.
