{"id":36886,"date":"2024-03-17T17:18:27","date_gmt":"2024-03-17T15:18:27","guid":{"rendered":"https:\/\/afteegypt.org\/?p=36886"},"modified":"2024-03-17T17:18:27","modified_gmt":"2024-03-17T15:18:27","slug":"aftes-weekly-legal-bulletin-1017-march-2024-releases-of-muhammad-abu-al-dahab-and-administrative-court-scheduled-a-sentencing-hearing-session-on-lawsuits-filed-by-afte-demanding-broadcas","status":"publish","type":"post","link":"https:\/\/afteegypt.org\/en\/legal-updates-en\/weekly-legal-bulletin-en-2\/2024\/03\/17\/36886-afteegypt.html","title":{"rendered":"AFTE\u2019s Weekly Legal Bulletin (10:17 March 2024)| Releases of Muhammad Abu Al-Dahab, and Administrative Court scheduled a sentencing hearing session on lawsuits filed by AFTE demanding broadcasting of the sessions of the House of Representatives and the Senate for May 26"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p><span style=\"color: #ffffff; background-color: #800000;\"><b>10 March 2024 sessions\u00a0<\/b><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #800000;\"><b>Administrative Court<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Administrative Court (Sixth Circuit) returned Appeal No. 57029 of 74, filed by AFTE against the decision of the Taibah Higher Institute to dismiss the student Omar Muhammad Ali, for pleading in the session of next April 21.The court instructed AFTE to inform the institute of the receipt of a certificate from the military prosecution proving AFTE\u2019s claim that Ali was imprisoned, and not absent.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The judge decided that the institute should be informed in its legal domicile and not through the State Council, given that the institute\u2019s representative did not attend the previous session.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The defense filed a request on November 6 to postpone the hearing session, awaiting the statement of military prosecution, indicating the student\u2019s imprisonment and duration. This occurred after the court insisted the previous time to issue a rule without waiting for the statement. The student\u2019s defense saw that this would lead to the rejection of the appeal, so it decided to request postponing the hearing pending the Military Public Prosecutor\u2019s letter to the prosecution to approve the implementation of the Administrative Judiciary Court\u2019s permit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Omar is spending his eighth year in detention after he was sentenced to 25 years in prison on February 7th, 2016. Since then, he has been trying to continue his studies at Thebes Higher Institute of Engineering, Architecture Engineering department, as he was arrested while enrolled in the third year.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Administrative Judiciary Court scheduled a sentencing hearing session on the two lawsuits filed by AFTE, demanding broadcasting of the sessions of <\/span><a href=\"https:\/\/afteegypt.org\/en\/legal-updates-en\/2022\/01\/05\/33337-afteegypt.html\"><span style=\"font-weight: 400;\">the House of Representatives<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/afteegypt.org\/en\/legal-updates-en\/2022\/01\/05\/33342-afteegypt.html\"><span style=\"font-weight: 400;\">the Senate<\/span><\/a><span style=\"font-weight: 400;\"> by various visual, audio, and written means, for May 26.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The Association of Freedom of Thought and Expression filed the two lawsuits in May 2021; the lawsuits were based on the Publicity principle stipulated in Article 120 of the Egyptian Constitution. In this regard, AFTE affirms the constitutionality of its demands and its firm position regarding the sessions being available for the public, as continuing not to broadcast the sessions will lead to the lack of citizens\u2019 overview over the legislative authorities and sets the citizens apart from the information, data, and statics discussed in the sessions which are a right of the citizens.
