Criminal Court Renews Detention of Mahmoud Abu Sarea for 45 Days Despite Inability to Attend Renewal Hearing

The Cairo Criminal Court (First Terrorism Circuit) renewed the detention of Mahmoud Gamal Abu Sarea for 45 days pending investigations in case No. 508 of 2023 (State Security), despite the defendant’s inability to connect from custody to attend the detention‑renewal hearing by video conference, and in violation of Article 143 of the Code of Criminal Procedure, which stipulates that pretrial detention cannot legally exceed two years.

Abu Sarea was arrested at Borg El Arab Airport on 19 December 2023 while returning from abroad on holiday with his family. No items were seized from him, and he was not confronted with publications or materials justifying his detention. He was presented to the Supreme State Security Prosecution the following day and is accused of joining a terrorist organization with knowledge of its aims, publishing and broadcasting false news harmful to public security and order, and using online accounts to disseminate false information.

The Criminal Court (Second Circuit Terrorism) decided to renew the detention of Mahmoud Gamal Abu Sreea for 45 days pending investigations in lawsuit No. 508 of 2023 (Supreme State Security), in violation of Article 143 of the Code of Criminal Procedure, which stipulates that pretrial detention cannot legally exceed two years.

Abu Srea was arrested by security forces on 19 December 2023 at Borg El Arab Airport upon his return from abroad to spend a holiday with his family. Although no contraband, publications, or posts were found in his possession, he faces charges of joining a terrorist group with knowledge of its purposes, publishing and broadcasting false news and statements that could harm security and public order, and using an internet account for publishing and broadcasting false news and statements.

The Criminal Court (First Circuit Terrorism) decided, in its session held on March 16, to renew the detention of Mahmoud Gamal Abu Sreea for 45 days pending investigations in lawsuit No. 508 of 2023 (Supreme State Security), in violation of the Criminal Procedure Code, which stipulates that pretrial detention cannot legally exceed two years.


Abu Srea was arrested at Borg El Arab Airport on December 19, 2030, while returning from abroad to spend a vacation with his family, despite having no confiscated items in his possession and no news or publications that would justify his detention.

He was brought before the Supreme State Security Prosecution the following day, where he was charged with joining a terrorist group with knowledge of its purposes, publishing and broadcasting false news and statements that could harm security and public order, and using an internet account for publishing and broadcasting false news and statements.



03 February 2026

The court’s decision comes in violation of Article 143 of the Code of Criminal Procedure, which limits the maximum period of pretrial detention to two years only.

16 April 2024

The Cairo Criminal Court (Third Circuit Terrorism) renewed the detention of Ahmed Husine Ahmed Abostit for 45 days, pending lawsuit No. 2468 of 2023 (Supreme State Security). Security forces had arrested him on October 24, 2023, in Abdel Moneim Riad Square due to his participation in the demonstrations in support of Palestine on October 20.

It is worthy to note that the prosecution accused him of joining a terrorist group with knowledge of its purposes and participating in a gathering intended to harm public safety and order, changing the government system through force, and forcing a public employee to refrain from performing one of his duties through intimidation and violence. To accomplish a terrorist purpose, the defendant destroyed public and private property, both immovable and movable.
