AFTE’s Weekly Legal Bulletin (24:31 December 2023)| The detention of 13 defendants renewed, including two journalists, four students, a doctor, two Al-Ahly club fans, and a member of Al-Tantawy’s presidential campaign

Criminal Court

The Criminal Court (Second Criminal and Terrorism Circuit) decided to renew the detention of the former TV presenter at Maspero, Hala Fahmy for an extra 45 days, pending investigations of lawsuit No. 441 of 2022 (Supreme State Security). It is worth noting that during the previous hearing, Fahmy requested to be referred to neurologists and orthopedists, even if at her expense, and the defense submitted a written request to the court to present her to specialist doctors.

Fahmy shared several videos on her Facebook profile sharing her economic views and the Renaissance Dam crisis; following that, Fahmy shared several live videos stating being pursued by unknown individuals; she was arrested a few days after this incident.

Cairo Criminal Court (Second Circuit) decided to renew the detention of journalist Karim Ebrahim, for 45 days, pending investigations of lawsuit No. 569 of 2020 (Supreme State Security Prosecution).

Security forces arrested the journalist at Al-Bawaba newspaper and a member of the Journalists Syndicate, in April 2020; he was arrested in connection with clashes between the police forces and armed members, which took place in the Alamiria district, his residence place. He was also unlawfully detained for a month before being brought before the investigation authorities, which accused him of joining a terrorist group.

The same Circuit decided to renew the detention of Moataz Bellah Hasab Elnaby for 45 days, pending investigations of lawsuit No. 965 of 2021 (Supreme State Security).

Hasab Elnaby completed two years in pretrial detention, which is the maximum period of pretrial detention according to the law. Security forces arrested Hasab Elnaby on July 12, 2021, against the grounds of several posts published on a Facebook account attributed to him; despite the fact that Hasab Elnaby denied his ownership of the account.

And renew the detention of the student Ayman Abdel Halim Eldarder for 45 days pending investigations of lawsuit No. 508 of 2023 (Supreme State Security). 

Eldarder was arrested on May 22 at Saray El-Koba metro station after the police forces stopped him and searched his mobile phone. He appeared before the prosecution on the following day, and it accused him of joining a terrorist group, spreading false news and information, and using an internet account to commit a crime.

Supreme State Security Prosecution

The Supreme State Security Prosecution decided to renew the detention of Omar Khaled Ragab Mahmoud Ghazy, a student at the Institute of Artificial Intelligence, for 15 days, pending investigations in Case No. 2469 of 2023 (Supreme State Security ), following his participation in demonstrations of solidarity with Palestine Friday, 13 October in Alexandria.

Security forces arrested Ghazy from the solidarity march on the Alexandria Corniche. The prosecution charged him with joining a terrorist group, spreading false news, and participating in a gathering that would put public peace in danger.

Also, Hany Baset Soliman’s detention’s renewed for 15 days pending investigations of lawsuit No. 2203 of 2023 (Supreme State Security). Soliman was arrested from the 50th anniversary of October’s victory over chanting and filming. 

Soliman faces accusations of joining a terrorist group, spreading false news, and using an account on social media to commit a crime. 

And decided to renew the detention of Ahmed Husine Ahmed Abostit for 15 days pending lawsuit No. 2468 of 2023 (Supreme State Security). Security forces had arrested him on October 24 in Abdel Moneim Riad Square due to his participation in the demonstrations in support of Palestine on October 20.

It is worthy to note that the prosecution accused him of joining a terrorist group with knowledge of its purposes and participating in a gathering intended to harm public safety and order, changing the government system through force, and forcing a public employee to refrain from performing one of his duties through intimidation and violence. To accomplish a terrorist purpose, the defendant destroyed public and private property, both immovable and movable.

Based on the same events, The Supreme State Security Prosecution decided to renew the detention of Ali Mohmed Ali Abo ElMajd, a student in the fourth year of the Faculty of Sharia and Law at Al-Azhar University, for 15 days, in Case No. 2468 of 2023 (Supreme State Security).

Security forces arrested Abo ElMajd on October 21 of this year, from his home in the Bulaq Al Dakrur area, due to his participation in the demonstrations in support of Palestine. He remained detained in an unknown place to his family and lawyer until his presentation to the Supreme State Security Prosecution on the 28th of the same month, which proceeded with investigations with him and decided to detain him in pretrial detention for 15 days, pending investigations. The prosecution charged Abo ElMajd with joining a terrorist group with knowledge of its purposes and participating in a gathering intended to harm public safety and order, changing the government system through force, and forcing a public employee to refrain from performing one of his duties through intimidation and violence. To accomplish a terrorist purpose, the defendant destroyed public and private property, both immovable and movable.

It also decided to renew the detention of Al-Tantawy’s presidential campaign member, Khaled Abdel Wahed Amin, for 15 days pending investigations of lawsuit No. 191 of 2023 (Supreme State Security) in which he’s accused of joining a terrorist group, spreading false news and information that would harm public peace and order, and using a social media account to spread false news and information.

The security forces arrested Amin from his house on August 27 as part of an expanded security campaign that targeted Al-Tantawy’s supporters, members of his campaign, and his relatives and friends.

Criminal Court

The Criminal Court (Third Circuit) decided to renew the detention of Doctor Hany Soliman for 45 days pending investigations of lawsuit No. 508 of 2023 (Supreme State Security Prosecution).

Security forces arrested Soliman, the former marketing director at Pfizer Pharmaceutical Company, on March 27 from his house after he published several posts on Facebook criticizing the current political regime. The prosecution interrogated him about these posts, and Soliman admitted his ownership of the publishing account and that he was expressing his political views.

The investigation authorities accused Soliman of joining a terrorist group, spreading false news, and using a social media account to spread the false news.

The same Circuit decided to renew the detention of Ahmed Shaker Abou Elrous and Ali Othman Ali for 45 days. Thus exceeding 8 months in pretrial detention over attending a football match between Al-Ahly and Ghazal El-Mahala.

The security forces arrested Abou Elrous and Ali from Cairo International Stadium on April 5. They transferred them to Nasr City prosecution, which decided to release them on bail after two days; however, the prosecution’s decision didn’t pass. On April 10, the security forces transferred them to be interrogated before the Supreme State Security Prosecution, which brought new accusations against them, namely, being a part of a terrorist organization, with knowledge of its aims, committing the crime of financing a terrorist group, spreading false news and statements that would harm public security and order, using an account on social media to spread the false news and information for a terrorist purpose.

Supreme State Security Prosecution

The Supreme State Security Prosecution renewed the detention of  Mohamed Ibrahim Abdo, for 15 days pending investigations of lawsuit No. 2064 of 2023 (Supreme State Security) which Abdo is involved in for posting videos on TikTok criticizing the policies of the current president of the country.

Security forces arrested the 31-year-old Abdo from his house in Monufia Governorate on August 21, he appeared before the prosecution a week after his arrest over accusations of joining a terrorist group, spreading false news, and using an internet account to commit a crime.
