Renewing the detention of 20 defendants, releasing “Esraa Abdel Fattah,” “Mahienour El-Massry,” and three others, and extending the precautionary measures of five more

The Legal Bulletin covers the lawsuits in which AFTE provides the necessary legal aid, following AFTE’s framework.

Criminal Courts:

The Third Circuit Terrorism renewed the detention of both “Mohamed Salah Abdel Aziz” and “Ahmed Yousry Ghaly” for 45 days, and The Council Chamber of the Criminal Court renewed the detention of both “Mohamed Mamdouh Abdel Halim” and “Zeyad Abou El-Fadl”, pending Case No. 855 of 2020, Supreme State Security.

The investigations charged them with joining and financing a terrorist group and spreading false news through using a social media account.

And on Sunday’s July 11 session, The Council Chamber of the Criminal Court held at Institute of Police Secretaries had issued a decision to release “Amr Adel” with precautionary measures, pending Case No. 558 of 2020 Supreme State Security, “Amr” was arrested on July 13, 2020, from Giza’s railway station “Amr” was arrested on July 13, 2020, from the railway station against the background of sharing a post on “Facebook”.

It also renewed the pretrial detention of “Belal Abdel Razek” and “Mohamed Gaber Soliman El-Masry” for 45 days pending Case No. 488 of 2019 Supreme State Security, both of the defendants were arrested in 2019 and their detention is still pending renewal till now.

And also considered the detention order of the defendants of  Case 751 of 2020 Supreme State Security, and ordered to renew the detention of two defendants for 45 days, and to extend the precautionary measures of two others for 45 days, and the investigations had charged them with joining Ultras White Knights.

The Third Circuit Terrorism renewed the pretrial detention of vice president of the “Strong Egypt” political party “Mohamed Ali Ibrahim Al-Qassas” for 45 days pending Case No. 786 of 2020, Supreme State Security. Notably, this case is Al-Qassas’s third case, as the security forces arrested him in February 2017, from Salah Salem road while he was heading to attend a wedding

In the same context, the third circuit terrorism considered the renewal of the detention order of Dr. Ahmed AlTohamy AbdelHay, who is working as an assistant professor of political science at the Faculty of Economic Studies and Political Science at Alexandria University since, and is in pretrial detention pending case No. 649 of 2020, for almost one year, as he was arrested in the 3rd of June last year, and was subjected to enforced disappearance for more than 2 weeks, and AFTE issued a statement that demands his release

On Monday’s session July 12, 2021, The Council Chamber of the Criminal Court renewed the detention of the Assistant Professor at National Research Centre “Hamed Sedeek,” for 45 days pending Case No. 1356 of 2019, Supreme State Security. “Sedeek” was arrested from his house on September 23, 2019, and he suffers from cruel detention conditions in Al-Aqrab Prison, in addition to being prevented from doing outdoor sports and receiving letters and books according to his lawyers and family’s testimonials.

The pretrial detention of “Islam Ali Muhammed” was renewed pending Case No. 1898 of 2019 Supreme State Security by The Council Chamber of the Criminal Court.

Despite exceeding two years in pretrial detention, The Council Chamber of the Criminal Court held at Institute of Police Secretaries renewed the detention of lawyer “Amr Nohan” for 45 days pending Case No. 741 of 2019 Supreme State Security, “Nohan” was arrested in 2019, from Karmus Police Station while performing his job as a lawyer

And pending Case No. 65 of 2021 Supreme State Security, The Council Chamber of the Criminal Court renewed the detention of “Mohamed Safani Kobeisy Marzouk”, “Hussein Ali Hussein” and “Naglaa Fathy Fouad” for 45 days, it should be noted that both “Mohamed Safani” and “Naglaa Fathy” were recycled in the current case.

pending Case No. 1956 of 2019 Supreme State Security, The Council Chamber of the Criminal Court renewed the detention of “Akram Mostafa Farouk, Mohammad Abd Ellah Mokhaimer, Mohammad Ahmed Mansour”, extended the precautionary measures for “Ahmed Mohamed Ali”, and issued a decision to release lawyer “Walid Elgendy”.

And also ordered to renew the detention of “Ahmed Hassanein Mohamed Moussa” for 45 days pending Case No. 1475 of 2019 Supreme State Security, with charges of joining a terrorist group, committing a financing crime, spreading false news, and misusing social media.

And issued a decision to release “Hossam El-Saadany” with precautionary measures, pending Case No. 558 of 2020 Supreme State Security, after he was arrested from his house in Alexandria on March 25, 2020.

And Today, July 18, The Council Chamber of the Criminal Court had decided to release “Mahienour El-Massry” pending Case No. 488 of 2019 Supreme State Security, “Mahienour” was arrested on September 22, 2019, in front of the State Security Prosecution headquarter, while attending investigations with several defendants as a lawyer.

It also decided to release journalists “Moataz Wednan” pending Case No. 1898 of 2020, and “Mostafa Al-Assar” pending Case No. 1898 of 2019.

Supreme State Security Prosecution

Abu Kabir Prosecution had decided to detain “Omar Mahmoud Abdel Rahman Al-Hout” 15 days pending investigations, and to include him in lawsuit No. 1873 State Security Misdemeanour of Abu Kabir. This came instead of releasing him after he had served his period of imprisonment of lawsuit No. 1044 of 2021, it should be noted that this is the 6th time “Omar Al-Hout” had been recycled after he was arrested in 2014.

Yesterday evening, July 17, The Supreme State Security Prosecution decided to release activist “Esraa Abdel Fatah”, pending Case No. 488 of 2019 Supreme State Security, after almost 22 months in pretrial detention.
