AFTE’s Weekly Legal Bulletin (11: 18 June 2023)| The detention of three defendants including content creator Ahmed Tarek was renewed; and a report to the attorney general regarding the assault and harassment of defendant Ahmed Oraby

Criminal Courts 

On June 11, the Criminal Court (Third Circuit) renewed the detention of Mohamed Mahmoud Amer Abdel Aziz for 45 days, pending investigations of lawsuit No. 1984 of 2021 (Supreme State Security Prosecution).

Amer was arrested on October 15, 2021, he was forcibly disappeared for about a month and a half, until he appeared before the investigation authorities, which accused him of joining a terrorist group.

 

On June 12, the Criminal Court (First Circuit) renewed the detention of pensioner Salah Elsayed Elqadi for 45 days, pending investigations of lawsuit No. 1691 of 2022 (Supreme State Security Prosecution).

In October 17, security forces arrester pensioner Salah Elqadi from his house; he faces accusations of joining a terrorist group, committing a terrorist financing crime, using a social media account to promote a terrorist act, participating in a criminal agreement intended to commit a terrorist crime, incitement to commit a terrorist crime, and spreading false news and information.

 

The Supreme State Security Prosecution

On June 12, the Supreme State Security Prosecution renewed the detention of content creator Ahmed Tarek Hassanein, for 15 days pending investigations of lawsuit No. 184 of 2023 (Supreme State Security).

The Supreme State Security Prosecution interrogated the content creator, known as “Chocolata” regarding their video “The Visit” in which he participated. The content of the video revolves around a detained person over his argument with a person of authority. All those who participated in the video were arrested as well. The prosecution accused the content creators of joining a terrorist group, committing the crime of financing terrorism, spreading false news and information, and using social media accounts to spread false news and information.

 

The Attorney General Office

 

On June 14, The defense teams of the Association of Freedom of Thoughts and Expression and the Egyptian Initiative for Personal Rights submitted a report to the attorney general to open an investigation into the incident of assaulting and harassing defendant Ahmed Oraby while being transferred to the Correction and Rehabilitation Center in Badr Prison 3. The report carried No. 33043 of 2023.

During Oraby’s last detention renewal hearing, he appeared before the Criminal Court with bare feet and a shaved head. He was also transferred to Badr Prison 3 as a form of punishment for opposing the poor treatment he received from one of the officers in his previous prison of Badr 1 Prison.

Oraby was arrested from his home on November 6, 2022, after writing several posts on Facebook discussing his political and economic views. He faces accusations of joining a terrorist group with knowledge of its purposes, committing a terrorist financing crime, inciting a terrorist act, participating in a criminal agreement for the purpose of committing a terrorist crime, spreading false news and statements, and using an account on social media to commit a crime.
