On March 24, the Administrative Court issued a verdict annulling Aswan University’s negative decision to refrain from appointing Dr.Haitham Mohamed Abdel-Baqy Abdel-Hafez as a Lecturer in Cardiothoracic Surgery at the Faculty of Medicine, ordering that he begin his new position. The lawsuit was filed by the Association for Freedom of Thought and Expression on behalf of Dr. Haitham against the President of Aswan University and the Dean of the Faculty of Medicine, under No. 2970 of Judicial Year 12.
Despite Dr. Haitham fulfilling all requirements, passing the necessary examinations, and being nominated for appointment, Aswan University refused to proceed with the appointment on the grounds of the absence of security clearance, prompting the applicant to resort to the Administrative Court to claim his legal right.

The Administrative Court of the State Council in Aswan has reserved for judgment the lawsuit filed by Dr. Haitham Mohamed Abdel-Baqy Abdel-Hafez against the President of Aswan University and the Dean of the Faculty of Medicine, registered under No. 2970 of Judicial Year 12. The court set 17 March 2026 as the date for issuing its ruling.
The lawsuit was filed by AFTE challenging the negative administrative decision to refrain from appointing Dr. Haitham Abdel-Baqy as a Lecturer in Cardiothoracic Surgery at the Faculty of Medicine, Aswan University, despite his fulfillment of all required conditions, successful completion of the necessary examinations, and formal nomination for appointment. The university refused to proceed with the appointment on the grounds of the absence of security clearance, prompting the applicant to resort to the Administrative Court to claim his legal right.
The case was referred to the State Commissioners’ Authority to prepare an advisory report on 14 April 2025. The report was issued in favor of the claimant, affirming his entitlement to appointment and calling for the annulment of the negative decision to halt the appointment procedures. A hearing was subsequently scheduled for 14 September 2025, then adjourned to 9 November 2025 to review the Commissioners’ report, and later postponed to 14 December 2025 to allow the administrative authority to submit its response.
At today’s session, the court reviewed the submitted documents and final pleadings and decided to reserve the case for judgment on 17 March 2026.
29 December 2026: AFTE Files Administrative Lawsuit to Demand University of Aswan to Appoint a Cardiothoracic Surgery Lecturer
AFTE filed a lawsuit before the Administrative Court at the State Council in Aswan, under No. 2970 of Judicial Year 12, on behalf of Dr. Haitham Mohamed Abdel-Baqi Abdel-Hafiz against the President of the University of Aswan and the Dean of the Faculty of Medicine.
The lawsuit challenges the negative decision to refuse the appointment of the plaintiff as a lecturer in Cardiothoracic Surgery at the Faculty of Medicine, despite fulfilling all the required conditions, passing the necessary examinations, and being nominated for the position. The university reportedly refused the appointment citing the absence of security approval, which prompted the plaintiff to turn to the administrative judiciary to claim his right.
The case was referred to the Commissioners’ Authority for a report on 14 April 2025, which was issued in favor of the plaintiff, confirming his right to appointment and annulling the negative decision preventing the completion of the appointment procedures.
The first court session was scheduled for 14 September 2025, then postponed to 9 November 2025 to review the Commissioners’ report, followed by another postponement to 14 December 2025 to consider the administrative authority’s response. The final session to examine the documents and closing briefs was set for 11 January 2026.
